MY EXPERIENCE OF LOOSING MONEY WITH RIVER HEIGHTS BY CAROL INFRASTRUCTURE AND LANDCRAFT BUILDER

Dear Friends, I am posting an interesting case where I lost money on booking of two flats with a builder named Landcraft Pvt Ltd (Also Carol Infrastrucure Pvt Limited) for River Heights Project on NH-58 Ghaziababd. Be careful of these builders and their middlemen   1. I visited the site in search of an HIG Flat on construction Linked Plan basis. However none was available and I was coming back. However one Mr Vikash Sharma who itroduced me as an associate of the company offered me a Poolfacing combination of MIG and LIG Flat which could be combined to be a better option and will be equivalent to an HIG when joined together. He shown me the model and explained me without any floor plan that my flat will be poolside.  2. I was then introduced to Mr Hemant Sharma as MD of the company by Mr Vikash Sharma which I took on the face value.  3. Since I was in a dilemma to book the flats he advised me to deposit a token amount of Rs 10000 which will be refunded should I opt not to buy the flats. I was also told that LandCraft is a big and reputed group which owns a number of Engineering Colleges and Medical Colleges. Little did I realize that I was in a systematic trap. 4. I was then made to fill up a form and was told that after the full booking amount was deposited an agreement will be signed and I will be given a copy of that. The signing was done in presence of one Mr Santosh who was introduced as Manager of the company. I told them to collect the cheque from my residence and after discussing with my Family members I will let them know my decision. 5. Accordingly Mr Vikash and Mr Hemant collected the cheques from my residence. However I asked them for Floor map which they promised to provide the next day. I was provided the floor map on 2nd Oct 2009 and I then realized that my flats can neither be combined to make equivalent to HIG and nor are facing poolside. Meanwhile they deposited and encashed the cheques before providing me the floor plans. 6. I thus decided to cancel my booking and submitted an application for refund. Now I am being told by Mr Santosh Kumar that Mr Hemant is not and employee of the company and LandCraft is not responsible for their commitments. The amount will not be refunded. 7. I was shocked to learn this from such a reputed builder.  May I request you all to sign the floor plans and verify with the actual allotment. The agreement should be made and booking amount should be made only after allotment along with the Floor Plans duely signed by the builder .  I HAVE LOST MY MONEY BUT LEARNT VALUEAVBLE LESSON: DONIOT TRUST BUILDERS AND THEIR ASSOCIATES AND DONOT SHELL OUT ANY MONEY BEFORE GETTING ALL THE COMMITMENTS AND SANCTIONED FLOOR PLANS DULY SIGNED BY THE BUILDER. ALSO REMEBER THE BUILDERS WANT TO SOMEGOW GRAB YOUR MONEY TO COMPLETE THEIR PROJECTS OR CLEAR THEIR LOANS. MAJORITY OF THE BUILDERS EVEN IN CONSTRUCTION LINKED PAYMENTS WILL TAKE APP 50% OF THE PAYMENTS WITHIN 30 DAYS AND WILL NOT START THE CONSTRUCTION. YOU MAY HAVE TO PAY EMI AS WELL AS RENT TILL NEXT AT LEAST FIVE YEARS. THEY WILL ALSO TRAP YOU BY OFFERING A PENALTY CLAUSE ON DELAY. IT HARDLY COMES TO RS 5000 AS AGAINST YOUR EMI OF 15,000 FOR A FLAT WORTH 15-20 LAKHS. S.B.Sinha
