Fraud in returning discount money via Credit Note

I booked a flat in Paras Tierea (Plot No. GH-01, Sec-137, Noida-Greater Noida Expressway, Noida – 201301 (U.P) Tel 0120-3142627 / 0120-3142727) Tower# 3, Unit# 205 (2 BHK, 960 sq ft. with INR 3475 per sq ft BSP) on the name of Jitin Verma and Payal Verma on 11-Sep-2011 through Mother Properties (1/12, Lalita Park Laxmi Nagar, Vikas Marg, Delhi – 110092. Mob No. – 9811025149).   Mother Properties gave me credit note (attached herewith) according to which, they committed to release the payment after 40% of payment from my side to the builder. This clause was completed by me on 16 Dec 2011 when I paid 49% of the total property cost to the builder.   It has been now over 1 year, I am chasing Mother Properties to give me the discount cheque but since Jan 2012, they are always keeping me in dark by saying that they haven’t recieved payment for my unit from builder and on every occasion, they commit that we will give you your cheque either after 1 week, sometimes 2 weeks, sometimes next month etc etc.   I am fed up chasing them, and now they have stopped picking my calls and I want to know that why I have to wait for their payment from builder to them since there is no such clause in my credit note that I will get my discount cheque only when Paras pay them the commission.   I will really appreciate if you can consider my case and help me to get my money from Mother Properties.   Many thanks in Advance,
